Welcome to Secret Stash, owned and operated by Aliansact France. These Terms of Service (ToS) govern your access and use of the Secret Stash platform, our APIs, and the mobile application. Secret Stash allows you to view, explore, create, buy, sell NFT and more generally, do anything that’s possible on the Ternoa public blockchain. NFT means a non-fungible token. Secret Stash is not a financial service, nor even an e-commerce platform. Secret Stash provides P2P services on the web3. We do not own or control these NFT nor the design or the metadata associated. Secret Stash does not guarantee the authenticity of the tokens sold, you are solely responsible for verifying the authenticity. Please read these terms of service carefully as they contain important information and affect your legal rights. By clicking accept and/or using our service, you agree to be bound by these terms and all of the terms incorporated herein by reference. If you do not agree to these terms, you may not access or use the service. The service offered by Secret Stash can be subject to change. We reserve the right to modify the ToS and have them validated by you before using the platform.

Accessing the Service

In order to use Secret Stash, like any other Web3 service, your public address is your identity. Therefore, in order to use Secret Stash, you will need a wallet to present your public address. Once authenticated via your wallet, you will be able to add personal information such as your social networks, a profile picture and a cover picture. By using your wallet to use our services, you agree to the terms of Secret Stash. Also, you are responsible for any actions related to this wallet. We do not take any responsibility for your actions, or any failure on your part. If you experience any problems with your wallet, please contact the wallet creator. You agree to inform us as soon as possible of any potential security breach in our services. Secret Stash may ask you to provide additional information and documents in certain circumstances, such as at the request of authorities. Access to our services may be interrupted for maintenance or bug reasons. Your access may be terminated if you fail to comply with Secret Stash's terms of service. We require that users of Secret Stash be at least 18 years old.

Ownership / Intellectual Property Rights

Everything on Secret Stash except the NFT / collections belong to Secret Stash. Logo slogan, design, cannot be copied, used without Secret Stash approval. We appreciate bug alerts, suggestions for improvement through the "Report a bug" button present on the platform. By suggesting improvements, tips, you give Secret Stash all the rights associated with your comments, proposed help.

Third-Party Content and Services

As a P2P web3 service, Secret Stash helps you explore NFT created by third parties and interact with the Ternoa blockchain. Secret Stash makes no warranties regarding such third-party content visible through our Service, and you are responsible for verifying the legitimacy, authenticity and legality of the NFT you purchase from third parties. NFT may be subject to terms and conditions between buyers and sellers regarding the use of NFT content and the benefits associated with a given NFT ("Purchase Terms"). For example, the creator's website may include Purchase Terms governing the use of the NFT that you must abide by. Secret Stash is not subject to these Terms of Purchase, which are solely between the buyer and the seller. The buyer and seller are solely responsible for accepting these terms of purchase. You are solely responsible for reviewing these Terms of Purchase. The Service may also contain links that allow you to access or use third-party websites. When you click on a link to a third-party website or application, even if we do not notify you that you have left our Service, you are subject to the terms and conditions of another website. Secret Stash provides links to these third party websites and third party applications solely as a convenience to you and does not review or endorse the content or products of these links. Your use of any links to third party websites, third party applications and third party items is at your own risk.

User Conduct

You also agree not to: - Impersonate any other person by using their account without their prior consent. - Usurp a pseudonym belonging to a third party. - Use a new Ternoa public address to get around a potential blocking of your account. - Spam other users with different NFT sent without their prior consent. - Use tools, bots, APIs that could jeopardize the operation of Secret Stash. - Use data export tools, robots, scripts, spiders, crawlers, scraper, browser extensions. - Perform any attack on Secret Stash such as identity theft, denial of service attacks, source code tampering or any other type of attack. - Use the Secret Stash service to defraud the community by presenting fake collections, pornographic collections, publishing links that present computer threats, other. - Use the Secret Stash service to perform illegal actions, such as money laundering. - Use the service to manipulate the market in any way. - Use Secret Stash to post content that is illegal and contrary to the Terms of Service, pedopornography, pornography, terrorism, deep fake, other . - Plagiarize any collection that you do not own the intellectual property rights to. - Use Secret Stash to harm other users in the community. Before using the service offered by Secret Stash, it is essential to do your own research (DYOR). It is necessary for you to verify the authenticity of a collection before making a purchase. You hereby agree to be solely responsible for your actions on the platform and Secret Stash reserves the right to act in accordance with the Terms of Service. To conclude, If you violate the rules, Secret Stash reserves the right to deactivate or delete your account and/or your ability to use our services. You agree that Secret Stash may take action if the rules are violated, and you acknowledge that we will have no obligation to you.

Indemnification

You agree to defend, indemnify and hold us, including all of our respective officers, partners and employees, harmless from any loss, damage, liability, claim or demand, including reasonable attorneys' fees and costs, asserted by any third party due to or arising out of the following : - Use of the site. - Your violation of these Terms of Use. - Breach of your representations and warranties set forth in these Terms of Use. - Your use or misuse of the Service. - Content. - NFT or Content linked or associated with an NFT. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, in our defense of any such claims.

Disclaimers

Your access and use of the service is at your own risk. You understand and agree that the service is provided on an “as is” and “as available” basis and Secret Stash disclaims all warranties or conditions of any kind, express or implied. We will not be responsible for any loss, whether of financial value or NFT resulting from improper user validation, sending to a wrong address.

Assumption of Risk

You are aware of and agree: - The value of an NFT is arbitrary. Just like crypto assets, NTFs have a volatile value. It is essential that you understand and accept that the loss of money due to this volatility is not the responsibility of Secret Stash. - As the legal aspects of NFT and crypto assets are not fully defined, you agree and understand that if regulations occur on these various assets, Secret Stash is not responsible for the loss of value of your collectibles. - As the legal aspects are not fully defined, you agree and understand that it is necessary to keep a record of your transactions in order to be able to report them to the appropriate authorities. - As explained above, you are responsible for the purchase of collectibles on Secret Stash, therefore you must verify the authenticity of the collections. You agree and understand that we are not responsible for counterfeit collections. - Purchasing collectibles on the Internet, and more specifically on the Web3, may be subject to malware that can impact your equipment. You agree and understand that Secret Stash is not responsible for dangerous content. - If you have a problem, dispute, with any collection, you agree and understand that you do not have to involve us, to hold us responsible for the inconvenience obtained from that dispute. Therefore, you waive any and all claims against Secret Stash for any of these conditions.

Limitation of Liability

You hereby agree that Secret Stash has not been, is not, will not be liable for any loss, profit in respect of the purchase/sale/trade of NFT on our platform.

Privacy Policy

Secret Stash will not process, host or transfer the Information collected about its Customers to a country outside the European Union or recognized as "not adequate" by the European Commission without prior notice to the Customer. We use Google Analytics to monitor and improve. We store user addresses and profile data for display purposes only, the user may remove any personal information at any time. We do not partner with any third party entity and we do not sell any data.

Modifications of the Service

Secret Stash reserves the right to modify, suspend or discontinue the services offered at any time and without liability.

Injunctive Relief

You agree that any violation of one or more of these terms will cause harm to Secret Stash. In such an event Secret Stash shall be entitled to equitable relief in addition to any other remedies available.

Miscellaneous

All of these terms constitute the entire agreement between Secret Stash and you regarding the use of our services. These Terms, and any associated rights, may not be transferred or assigned by you without the consent of Secret Stash. No waiver by either party of any breach or default hereunder shall be deemed a waiver of any preceding or subsequent breach or default.
